Terms & Conditions – Live Plant Sales
1. Nature of Products
All plants and cuttings offered for sale are perishable, living goods. By purchasing, the customer acknowledges the responsibility required to properly care for live plants after delivery.
Every cutting sold has been bloom-confirmed by me personally before propagation to ensure varietal accuracy and health at the time of shipping.
2. Order Policy
- All sales are final. No cancellations, substitutions, or combined orders will be accepted once an order is placed.
- If you place multiple orders, shipping may be combined at my discretion. In such cases, I will refund any excess shipping charges minus Shopify’s processing fee (3% + $0.30 per transaction).
- Availability is limited and not guaranteed until checkout is completed.
3. Shipping & Handling
- Orders ship via UPS 2nd Day Air with foil insulation. In hot climates, ice packs will be included at my discretion.
- Shipments are scheduled for Monday, September 15th or Tuesday, September 16th to reduce weekend delays.
- If you prefer overnight shipping, you must email me immediately after placing your order; I can upgrade for an additional cost.
- It is the customer’s responsibility to be available to receive the package upon delivery. If a package is left unattended (e.g., in the sun, at a parcel locker, or on a porch), I am not liable for damage due to heat, cold, or delays in opening.
4. Condition Upon Arrival
- I guarantee that cuttings leave my care healthy and viable.
- Customers must inspect their order immediately upon delivery. Any concerns about plant health must be reported within 6 hours of delivery and must include clear photographs of the plants in their original packaging.
- If no claim is made within this window, the order is considered accepted as healthy.
5. Limitations of Guarantee
- Once plants arrive in healthy condition, their ongoing survival and performance are the responsibility of the customer.
- I am not responsible for issues that develop after delivery, including but not limited to: improper planting, watering, soil conditions, pests, viruses, diseases, or weather events.
- Please note: Dahlias in general carry viruses at varying levels. I discard stock showing obvious virus symptoms, but I do not guarantee virus-free plants. If you are not comfortable with this reality, please reconsider before ordering.
6. Customer Agreement
By placing an order, the customer agrees to:
- Accept all risks associated with purchasing and growing live plants.
- Assume liability once the order has shipped.
- Ensure they have sufficient knowledge and experience in caring for live plants (including off-season storage or “wintering” if applicable).
- Respect communication policies: I am a small business and can only track inquiries via email. Please do not contact me via Facebook Messenger or phone. I aim to respond within 48 hours, but allow up to 5 business days during peak seasons.
- Communicate respectfully. Harassment, threats, intimidation, or abusive language will not be tolerated.
7. No Performance Guarantee
No guarantees are made regarding plant performance, bloom form, or the outcome of customer care. Gardening always involves risk, and results will vary based on conditions beyond my control.
